Several join in class action ERISA suit against UnitedHealthcare

Several healthcare providers, ambulatory surgical centers, chiropractic associations, and durable medical equipment providers have recently joined in on a class action ERISA lawsuit filed against UnitedHealthcare.  The lawsuit was initially filed on January 24, 2011 by a small group of chiropractors for violations of the Employee Retirement Income Security Act by UnitedHealthcare subsidiary OptumHealth.

The lawsuit is being expanded to include any healthcare providers that were subjected to UnitedHealthcare’s overpayment recoupment and pre-service claim denials.  ”Healthcare overpayment recoupment market is estimated to be over hundreds of billions of dollars…This UHC ERISA class-action, along with other overpayment ERISA class actions, will become a historical and unique part of U.S. healthcare history,” said one ERISA expert.
